1. Identification of the site and of the responsible organisation

Modern information and communication technologies play a fundamental role in the activities of an organisation such as KIPIWI.

Our main activities are the creation and assistance with the creation of personalised paper documents and the supply of services liked to this activity (hereinafter the Services). The Services are all services provided by the Site, in particular : services covering the hosting, enhancement and provision of content, of communication between the Members, the provision of tools and more generally all other services proposed by the Site. The Services also include communications for the intention of Members such as, in particular, the administrative messages, the newsletter relating to the Services, etc.


Within this framework, KIPIWI undertakes to scrupulously respect Belgian legislation governing the protection of private data. This legislation is available in full on the site of the Privacy Commission : http://www.privacycommission.be

2. Anonymous access authorisation and acceptance of our privacy policy

You may access our home page and consult the Site without providing us with your personal data.

By using the Site, you explicitly declare that you accept the privacy policy of KIPIWI, and that you authorise us to collect and process data relating to you according to the terms and conditions and principles described in this policy.

3. Identification of the Site users

The Site is visited and used by various categories of persons concerned and who may have various reasons for processing the data :

                             the Site including certain contents published by the Members;

·                                . Member: All persons having registered by giving an identifier (their e-mail address) and a password as well as some

                                additional information, in order to have access to the Services reserved to the members after having 

                                accepted the General Conditions

·                                . Client : all Members that have made a purchase using the Kipiwi Services after having accepted this privacy policy

·                                . Users : All of the Visitors, Members and Clients.

 

4. Automatic information collection

Each time a User visits an Internet site, the following information is collected :

·                                Page preceding arrival on the site

We collect these data only for the purpose of compiling visitor statistics and we do not link them to personal data collected elsewhere.

KIPIWI does not establish a link between information automatically recorded by the cookies and nominal data concerning our visitors.

 

6. Data collected and specification of the purposes

We only collect your personal data if you supply them voluntarily. We can also collect information relating to you from other sources such as organisations that process your personal data and have obtained your authorisation to transmit them to third parties.

The data that we collect when you register on the Site are only those that are necessary for the processing of your data corresponding to the purpose for which you have entrusted us with them. No sensitive data (racial origin, information linked to health, to political opinions, etc.) is requested and shall not be collected using other databases. You are invited to complete a form, where certain fields in bold or followed by an asterisks (*) are necessary to be able to offer the requested service while others are optional. The latter are only destined to allow us to contact you quickly if this is necessary or to identify as accurately as possible your centres of interest in such a way as to send you information corresponding to them.

7. Purposes of the data processing

The purposes for which we collect your data are the following depending on the type of Site User. The data collected will be those that will be strictly necessary for the purposes of the processing for which you have given your express authorisation.

Visitor :

·                                Management of requests linked to an Offensive Content reported by the Member:

·                                Management of the contents of the personal and shared spaces ;

·                                Management of an information request ;

·                                Sending of promotional information adapted to your centres of interest both from KIPIWI and from its

                 commercial partners.

                 For this purpose, at all times you shall have the right to refuse to receive any message containing direct marketing in

                 future and this, without incurring any 

                 costs and without having to give any justification :

   

1.       either by contacting the contact person mentioned in point 1 above ;

2.       or by directly answering our partner if you no longer wish to receive commercial offers from this partner ;

    

Client:

·                                Management of the site visitor statistics ;

·                                Management of the Client file and of their orders ;

·                                Management of requests linked to Offensive Content that the Client reports ;

·                                Conduct of market studies ;

·                                Management of an information request ;

·                                Sending of promotional information adapted to your centres of interest both from KIPIWI and from its commercial 

                 partners. For this purpose, you shall have the right at all times to refuse in future any message containing direct

                 marketing and this without incurring any cost and without justification :

 

1.       either by contacting the contact person mentioned under point 1 above ;

2.       or by directly answering our partner if you no longer want to receive commercial offers from this partner ;


If we wish to use your personal data for a new purpose, we will ask you for your consent prior to this new use.

This privacy policy cannot restrict the rights that KIPIWI may hold with regard to all physical persons by virtue of contracts or another legislation.

 

8. Disclosure of data to third parties

Kipiwi reserves the right to send you the commercial offers of our commercial partners except in the event that you inform us that you wish to waive this possibility. You shall have at all times the right to refuse to receive direct marketing from these partners.

We reserve the right to transmit personal data at the request of a legal or administrative authority by virtue of the law.

 

9. Duration of conservation of data

The data collected are conserved for an indeterminate duration, as long as you do not wish to unsubscribe from the services to which you have subscribed.

Your data will no longer be processed within the framework of these Services as soon as you so request by contacting us on the address indicated under point 1 above.

Beyond this duration, they shall be kept for exclusively statistical purposes or within the framework of legal obligations such as accounting, and shall not give rise to any exploitation, of whatever nature. 

 

10. Confidentiality and security

We do not give the Site’s visitors the possibility of using a secured transmission method to send us personal data.

Our site and our company comply by a policy, rules and security measures that set out to protect personal data.


KIPIWI :

1.       shall do everything possible to keep the data updated, to rectify or delete the incorrect, incomplete or irrelevant data ;

2.       shall ensure that for the persons acting under its authority, access to the data and the possibilities of processing are limited to what these persons need for the exercise of their functions or to what is necessary for the needs of the service ;

3.       will inform the persons acting under its authority of the provisions of the Belgian law and of its enforcement decrees, as well as any relevant provision, relating to the protection of privacy with regard to processing of data of a personal character;

4.       shall ensure the compliance of the programmes that are used for the automated processing of the data of a personal nature with the terms of the declaration of the Privacy Commission and ensure that they are correctly applied;

5.       shall ensure that all persons acting under the authority of the person responsible for processing or that of a subcontractor, as well as the subcontractor himself that accesses personal data, can only process them on the instruction of the person responsible for processing, except in the event of an obligation imposed by or by virtue of a law, a decree or an ordinance.

6.       shall take and oblige its subcontractors and partners to take the technical and organisational measures required to protect the data of a personal character against accidental or non authorised destruction, against accidental loss and against the modification, access and any other non authorised processing of data of a personal character. These measures shall ensure an appropriate level of protection, in the light of, on the one hand, the progress of the technology in the matter and the costs incurred by the application of these measures and, on the other hand, the nature of the data to be protected and of the potential risks.


When the processing is entrusted to a sub-contractor, KIPIWI :

1.       shall choose a subcontractor that offers sufficient guarantees with regard to technical security and organisation measures relating to the processing ;

2.       shall ensure respect for these measures, in particular through the stipulation of contractual obligations ;

3.       shall define in the contract the responsibility of the subcontractor with regard to the person responsible for processing ;

4.       shall agree with the subcontractor that it shall only act on the instruction of the head of processing and is bound by the same obligations as that to which the processing manager is obliged by virtue of the law ;

5.       shall record in writing or on an electronic support the elements of the contract relating to the protection of data and the demands relating to the security measures ;

 

11. Access to your personal data processed by KIPIWI

You can ask us, by sending a registered letter to the contact person mentioned under point 1 above, if we hold personal information relating to you. We will ask you for proof of your identity (copy of your identity card or passport) to make sure that we respect your personal data and do not send it to third parties. We will accept only one request per annum and per person. The information that we hold about you or a note specifying that we do not hold it, will be sent to you free of charge, within thirty days of your request. You have the possibility of contesting the data that we hold about you and of having them deleted, rectified, modified or completed.

The Members and Clients can have online access to their personal space and modify if necessary the data relating to them.

The newsletters, e-mails, mailings and letters that you will receive will always mention the possibility of refusing the receipt of any message in future and of modifying your personal data if necessary.
